911 Health Watch Calls On HHS Secretary Kennedy to Remove WTC Health Program Hiring Freeze, Allow Research to Continue and Finally Announce Pending Decisions to Include Cardiac, Autoimmune and Cognitive Issues to the List of Covered 9/11 Conditions

Today, 911 Health Watch released the following letter to Health and Human Services Secretary Robert F Kennedy Jr.

In the letter, we are calling on the Secretary to:

Remove the hiring freeze he has imposed on the World Trade Center Health Program, and allow it to bring the staff to full strength to ensure quality care and allow critically needed research to go forward;

Lift his communications restrictions between the program and the 9/11 community; and

Ensure that the WTC Health Program finally makes a decision on petitions that have been pending for over three years to add cardiac, autoimmune and cognitive issues to the list of covered conditions.

Fifteen years ago, on January 2, 2011, then-President Obama signed the James Zadroga 9/11 Health and Compensation Act into law, which created the World Trade Center Health Program.

This was the result of nearly a decade of advocacy by the 9/11 community, responders, survivors and their advocates—who had to overcome years of resistance by the Federal Government to responding to the mounting health crisis resulting from exposures to the toxins released at Ground Zero.

The World Trade Center Health Program is now caring for over 140,000 members: responders at the World Trade Center, the Pentagon and Shanksville crash sites, as well as workers, students, and other survivors exposed to the disaster in lower Manhattan and Western Brooklyn. They live in every state, and in 434 out of 435 Congressional districts.

Regrettably, though, the World Trade Center Health Program is at risk because of the continued chaos that Secretary Kennedy and his directives are causing.

Over the last 11 months, since Secretary Kennedy took over as Secretary of Health and Human Services, he has ignored the program’s staffing needs, resulting in disruptions to key WTC Health Program operations prescribed by Zadroga Act.

RFK, Jr. has fired program staff, then rehired them; then fired different program staff; then fired the Program Director, Dr. John Howard; then rehired some staff (but really didn’t reinstate them). Then finally he actually rehired the staff and the Program Director. When the Secretary testified before Congress and was questioned about these reckless and irrational actions, he admitted that the firings were “a mistake”.

After the dust cleared from his waves of firings and rehiring’s, the program now has fewer staff members to run the program than when he took over.

The program’s staffing level, which was 93 on inauguration day—and slated to expand to 120, as authorized by the Office of Management and Budget—now stands at 84.

That means there are 36 vacancies—more than 25% short of the minimum staff needed to ensure medical monitoring and treatment for the responders and survivors enrolled in the program.

This decline in staffing has occurred as program enrollment has continued to grow. It has grown by approximately 20,000 in the last two years and is on track to increase by another 10,000 this year— nearly 25% increase.

25% fewer staff are trying to serve 25% more members. But the program cannot hire the staff needed because of the Secretary’s ongoing CDC-wide hiring freeze.

The staff shortage has damaging effects: slower treatment approvals, backlogged research grant authorizations, and less-than-adequate supervision of the program’s vendors and contractors—especially the program’s National Provider Network (NPN) managed by MCA Sedgwick, which has had significant problems delivering services to 9/11 responders and survivors since the day it started work for the program in 2022.

You cannot run a program with more responders and survivors needing services with less staff and expect care not to suffer—especially a program that depends on so many vendors and contractors who need supervision. But that is what is happening.

There is another effect of the staff shortage. Under the Zadroga statute, the program funds research on medical conditions caused by 9/11 toxins. Earlier this year the Secretary disrupted research on 9/11 cancers—canceling, then restoring, already-approved research. This year’s research awards process, which normally would have started in March of 2025, still has not yet begun; we have only vague promises that it will be done this year, if at all.

Under the Zadroga statute, there is also a process for adding new medical conditions to coverage under the Act, provided certain requirements are met. For over three years, several petitions have been pending review cardiac conditions, autoimmune conditions, and cognitive issues.

The program had announced in December 2024 that the delayed determinations would be finally announced in March of 2025 this past year, but that did not happen. And there’s no indication when—or if—an announcement will happen, probably because of the “temporary” communications pause on staff contact with the public that Secretary Kennedy imposed when he took over. (That pause has been repeatedly denied by HHS press staff, even in the face of evidence.)

The truth is that HHS has set such limitations on the program communicating with the public that the members of the two Advisory Committees (made up of responders and survivors), which previously met nearly every month, have only been allowed to meet once.

As we approach the 25th Anniversary of the 9/11 attacks, the Secretary must lift his hiring freeze and allow the program to hire the staff it needs to ensure quality care and allow research on 9/11 conditions to go forward.

He needs to end his communications restrictions.

Finally, the program should announce its decisions on pending petitions.

This week, Secretary Kennedy reversed himself and has rehired hundreds of CDC staff that he fired last year.

Now he needs to allow the World Trade Center Health Program to hire the staff it needs to fill vacancies so the program can fully function. He needs to remove his restrictions on the program communicating with the 9/11 community and he needs to have the program finally make its decisions on pending petitions to determine if the program should cover cardiac , auto immune and cognitive conditions. 9/11 responders and survivors have been waiting for years to hear if the program would cover these conditions and it is long past due for a decision.

The staff running the federal World Trade Center Health Program has dropped by 25% as the number of sick 9/11 survivors the group treats is expected to increase by 10,000 this year, the Daily News has learned.
Survivor advocates are demanding U.S. Department of Health and Human Services Secretary Robert F. Kennedy Jr. lift the agency’s hiring freeze and fully staff the program before the personnel shortfall adversely affects first responders and survivors seeking help.
“Over the last 11 months, since you took over as secretary of Health and Human Services, you have ignored the program staffing needs, resulting in disrupting key WTC Health Program operations,” Benjamin Chevat, executive director of 9/11 Health Watch, wrote in a letter to Kennedy earlier this week that was acquired by The News.
“Today the [program] is at risk because staffing and policy approvals have not kept up with the increased demand for services — necessary, often lifesaving services that exposed, ill members rely on.” ........

New York City Department of Investigation Commissioner Jocelyn Strauber, who has done a stellar job these past four years, must rescind her resignation (which is effective this coming Friday) and Mayor Mamdani must agree to keep her on. Both Strauber and Mamdani will benefit, as will the city government of more than 8 million New Yorkers.

And there is other unfinished work, as Strauber has been directed by the City Council to prepare a report on the city’s knowledge of health risks in the areas near the World Trade Center following the 9/11 attacks. That report, which could help clarify what the city knew and when after now nearly a quarter century of stonewalling by successive mayors, is due in roughly a year and a half.

We don’t doubt the ability of the DOI in Strauber’s absence to carry on with this mission, but she’s already demonstrated she can handle sensitive matters professionally and independently from City Hall pressure, so why not keep her at the helm? (On that note, Mamdani himself should move towards releasing the WTC files independent of the DOI.)

Mayor Adams’ Record Appeal Officer has directed a response to the Freedom of Information Law request of 911 Health Watch by February 27, 2026. This directive leaves the work of responding to our FOIL request, now two and half years old, to the Mamdani Administration.

Because of years-long delays, 911 Health Watch filed an Administrative Appeal of the Mayor’s effective denial of the FOIL request.

The Records Appeals Officer responded on December 24. While denying the appeal, the Officer ordered the Mayor’s Office to respond to our request by February 27, 2026.

911 Health Watch again calls on Mayor-elect Mamdani to release the “Harding Memo”, a document the New York Times reported was sent to then-Deputy Mayor Harding in October 2001. “A memo to Deputy Mayor Robert M. Harding from his assistant in early October said that the city faced as many as 10,000 liability claims connected to 9/11.” (New York Times, May 14, 2007, “Ground Zero Illnesses Clouding Giuliani’s Legacy”)

Mayor-elect Mamdani should commit his administration to full cooperation with the City Council-ordered DOI investigation of the 9/11 documents, and provide DOI with the resources needed to find out what the City knew regarding the health hazards at Ground Zero and when the City knew it.
Mayor-elect Mamdani can be the Mayor that finally resolves this issue on behalf of tens of thousands of first responders, workers, and residents in and around Ground Zero after 25 years of denial by four Mayoral Administrations.
In addition, regarding 911 Health Watch’s Article 78 proceeding seeking testimony from the City as to why it originally denied it had any records about 9/11, DEP unsurprisingly opposes 911 Health Watch’s request for live testimony. (NYC Response and 911 Health Watch Reply).

We are now awaiting a Court decision.

911 Health Watch and its attorneys, Andrew Carboy and Matthew McCauley, will continue their work to get the answers City Hall refuses to provide.

Benjamin Chevat, Executive Director of 911 Health Watch Inc, stated:
“Mayor-Elect Mamdani can be the Mayor who after 25 years answers the question: what did the City know about the hazards caused by the toxic chemicals at Ground Zero, and when did it know it? He can do that by ordering his yet to be named Corporation Counsel to release the ‘Harding Memo’ and the data that went into drafting it, by supporting and fully cooperating with the City Council’s DOI investigation and by making sure DOI has the funding to do its job.”

Explained Andrew Carboy:

“At the agency level and in Supreme Court, the DEP worked to dismiss our case for two years, asserting we had no reason to claim the documents existed, in the first place. Now, after admitting to us that it had hundreds of thousands of September 11th records, DEP refuses to explain itself, voluntarily. We request the Supreme Court direct DEP officials to testify, under oath, and provide New Yorkers with the answers they deserve.”

Matthew McCauley stated:

“The City’s opposition is a contradiction by first assailing us for “… merely recit[ing] the procedural history …” and then laughably claiming its current “… extraordinary transparency ….”

The 9/11 terrorist destruction of the World Trade Center and murder of 2,753 people and the resulting environmental health catastrophe that has taken thousands of more lives of responders and survivors was nearly a quarter century ago and four mayors, Rudy Giuliani, Mike Bloomberg, Bill de Blasio and Eric Adams, have all kept the city’s records out of public view.

Zohran Mamdani, who takes office in three days, must end this deception and order that all WTC files be published. Immediately. Twenty five years of a coverup over what city officials knew of the health hazards at Ground Zero and when they knew it is long enough.

The excuse offered by mayors and their top government lawyer, the corporation counsel, has been that the city wants protection from lawsuit liability should anyone sue. But that’s a phony issue.

What World Trade Center Health and Wellness Program study found about PTSD in 9/11 first responders

Glen Klein said he endured years of nightmares, heavy drinking and bouts of rage before he sought help for post-traumatic stress disorder.

The old, yet lingering stigmas surrounding mental health treatment among first responders delayed Klein — a retired detective specialist with the NYPD’s Emergency Services Unit — and others from receiving the help they needed while reeling from the sights, sounds and smells of Ground Zero after the 9/11 terror attacks.
"Even if you sign up to be a police officer or a firefighter, never in our wildest dreams did we ever think that we would be digging bodies out from two 110-story buildings for almost a year," said Klein, 67, of Centereach, who has been diagnosed with chronic PTSD. "It was common to see dead bodies because we deal with homicides and bad car accidents. But to have almost 3,000 people buried in the rubble ... it has to affect you pretty severely."…….

The research revealed an abnormality in their brain composition.
