USA: AMERICANS WITH DISABILITIES ACT: ADA
The Department of Justice adopted the first ADA Standards for Accessible Design (“ADA Standards”), on July 26, 1991, known as the 1991 ADA standards and adopted revised ADA Standards on September 15, 2010, known as the “ 2010 ADA Standards” along with guidance on the 2010 standards which addresses the changes to the ADA Standards, the reasoning behind those changes, and responses to public comments received on these topics.
I- WHAT IS THE MEANING OF THIS LAW:
The law that protects the rights of people with disabilities in the United States is called the ADA. Here is what this law means and how to navigate it. > refers to adhering to the AMERICANS WITH DISABILITIES ACT standards for Accessible Design, requiring businesses and state / local governments to ensure equal access for people with disabilities.
This includes physical barrier removal (ramps, restrooms), effective communication, and digital accessibility for websites, with non-compliance leading to lawsuits, high fines, and reputational damage.
II- WHAT ARE KEY REQUIREMENT FOR ADA COMPLIANCE:
1- PHYSICAL SPACE: Requirements include providing accessible parking, wheelchair ramps, wide doorways, elevators, and accessible restrooms.
2-DIGITAL ACCESSIBILITY: Websites must be accessible, incorporating alt text for images, keyboard navigation, and proper color contrast (commonly adhering to WCAG 2.1 guidelines).
3-EFFECTIVE COMMUNICATION: Businesses must provide auxiliary aids (interpreters, captions) to ensure effective communication with people with disabilities.
4-EMPLOYMENT: Employers with 15 or more employees must provide "reasonable accommodations" to employees with disabilities, such as modified workstations.
III- HOW TO ENSURE ADA COMPLIANCE FOR BUSINESSES:
• CONDUCT AN AUDIT: Review physical locations and digital assets against the 2010 ADA Standards for Accessible Design.
• REMOVE BARRIERS: Remove architectural barriers in existing facilities where "readily achievable".
• DIGITAL AUDIT: Use tools to test for web accessibility and fix errors.
• CONSULT EXPERTS : Hire a Certified Access Specialist (CASp) to inspect your location.
IV- WHAT ARE THE PENALTIES FOR NON COMPLIANCE:
1- LAWSUITS: Private individuals can file lawsuits to enforce their rights.
2-FINES: Fines can be significant, with initial violations in California, for example, often exceeding $4,000 plus legal fees.
3- GOVERNMENT ACTION: The Department of Justice (DOJ) can initiate investigations and legal action.
V- HOW TO FILE AN ADA COMPLIANCE COMPLAINT:
1- If you have experienced discrimination or encountered a barrier, you can file a complaint directly with the DOJ.
2- Online: Submit complaints via the ADA.gov portal.
