Next week, IBFAN will be at the 49th Session of the Codex Labelling Committee (CCFL49) in Ottawa, Canada (11–15 May), to oppose a USA proposal that would allow flexible labelling and ingredients for emergencies.

IBFAN believes these guidelines will create dangerous double standards – putting those in situations of food insecurity, famine and food deprivation at even greater risk. Flexible labelling also complicates traceability and recall procedures for contaminated or unsafe food – at a time when formula possibly contaminated with cereulide has already been exported to Ukraine, the Gaza Strip and the West Bank.

IBFAN WEBINAR on Food Safety with Yasmine Motarjemi, Nestlé Whistleblower

In November, a new US company called ByHeart recalled its Powdered Infant Formulas (PIF) in the USA because of risk of Clostridium botulinum contamination. This was followed in January, with a recall in 60+ countries of Nestlé’s infant, follow-on, pre-term and specialised formulas Austria’s Health Ministry has said that the recall is the largest in the company’s history, affecting more than 800 products from over 10 Nestlé factories. Contamination outbreaks are especially problematic in the Global South and settings where the risks of using formula are greater, diagnosis is restricted and access to treatment is reduced. The global online promotion and sale exacerbates the risks, idealising products and encouraging unquestioning trust.

One of our key speakers will be Yasmine Motarjemi, WHO’s Food Safety Senior Officer from 1990-2000 and Global Director of Food Safety at Nestlé and Assistant Vice-President (2000 to 2010). Yasmine will explain how she was forced to leave her job after repeatedly raising concerns about Nestlé’s mismanagementof food safety. All the time she was in post at Nestlé, her department of food quality, the cockpit of the Company,was never inspected by government authorities, not even when food incidents occurred. She refused to be silenced and became a whistleblower. Her new book Ce que l’empire Nestlé vous cache(What the Nestlé empire is hiding from you) was published in 2025 Bernard Nicolas, Yasmine Motarjemi.

ByHeart & Botulism: Serious food safety failings expose online marketing risks - Capitalising on Trump’s Make America Healthy Again agenda, the new US company ByHeart has been promoting its infant formulas direct to consumers via global platforms such as Amazon, claiming its products are pure, healthy, “filled with ingredients backed by breast milk science in every scoop” and have undergone ‘rigorous testing going above and beyond what is required’ Through such marketing ByHeart’s formula market has grown fast and spread to Canada, Africa, the Arab world, Asia and Latin America.

The ByHeart story is a lesson in deception. The U.S. Food and Drug Administration (FDA) has investigated ByHeart factories since its launch in 2022, and has found multiple safety violations, leaking roof, mold in a water tank, 2,500 dead flies – enough to raise an Official Action Indicated (OAI) red flag, its highest tier of concern. Now, ByHeart’s infant formula has been identified as the cause of at least 39 cases of potentially deadly infant botulism in 18 US states with a further 70 infants under investigation.

ByHeart says that it has recalled the products and admits all could be contaminated. However, the products are still onsite in some stores and what about online sales outside the US? The single treatment for infants is only available in the US on ‘a case-by-case evaluation basis.’

IBFAN is calling for a global recall, mandatory reporting of infections, a revision of Codex and WHO’s Food Safety Guidelines and a new World Health Assembly Resolution – calling on all governments to urgently implement the International Code.

PRESS RELEASE - Regarding the US nationwide recall of ByHeart infant formula following the recent Infant Botulism outbreak.

Breastfeeding International is calling for full transparency, independent investigation, and immediate regulatory action to protect infant health and urges the following actions, among others:

* Full Disclosure and Independent Oversight of ByHeart's production data and testing results.

* Protection and Support for affected families.
Suspension of all ByHeart marketing activities.

* Strengthened Regulation and Enforcement by the FDA to close systemic gaps in formula oversight.
