Texas, leading a coalition of states, is engaged in federal litigation, Texas v. Kennedy (2026), that challenges the scope and constitutionality of 2024 updates to Section 504 of the Rehabilitation Act. The lawsuit argues that new federal rules regarding the "integration mandate" (requiring community-based care for disabled people) are unlawful and an overreach of federal authority.

Context: The lawsuit initially challenged the inclusion of gender dysphoria under Section 504 protections. It evolved into a broader challenge against updated HHS regulations regarding the rights of disabled people to receive services in the most integrated setting.
Targeted Regulations: Texas and other states are asking the court to declare the updated 2024 Section 504 rules unlawful and stop their enforcement.
Potential Impact: Disability advocates warn that this legal action could undermine the legal protections that prevent unnecessary institutionalization of people with disabilities.
Status: As of early 2026, the case is ongoing, with nine states, including Texas, continuing to challenge the federal regulations.
