Nolichucky Witness is a group that has come together out of concern for the Nolichucky River and its headwaters as CSX and it's contractors work to restore the Clinchfield Railroad.

Urgent! Take Action to Protect the Nolichucky River from CSX
Deadline January 20

The Nolichucky River is at risk due to CSX's negligent rebuilding practices. We need your help to demand accountability and prevent further environmental damage.

First! Demand a Public Hearing

Email your request for a public hearing to [email protected] regarding permit nrs24.232 by Matthew Adkins of CXS immediately. TDEC must hold a public hearing on this critical issue. Include NRS24.232

Second! Comment on CSX's Permit Request

Submit your comments on CSX's Permit Number NRS24.232 by Matthew Adkins of CXS to [email protected]. Use the subject line "Comment on NRS24.232" and include these key points:

CSX's Disregard for the Environment:
CSX has repeatedly violated environmental regulations, excavating below the Ordinary High Water Mark (OHWM) and removing excessive amounts of river cobble.Their actions threaten the stability of the riverbed, water quality, and wildlife habitats.

Lack of Oversight:
TDEC and the US Army Corps of Engineers have failed to provide adequate oversight, allowing CSX to operate unchecked. We demand stricter enforcement and weekly inspections to prevent further damage.

Protect Our River:
The Nolichucky River is a vital natural resource that supports recreation, tourism, and local economies. We must hold CSX accountable for their actions and ensure the long-term health of the river.

Additional Talking Points: CSX's intentional avoidance of clarity in determining the OHWM.

Lack of USACE guidance and specificity regarding the OHWM location.

Removal and use of thousands of cubic yards of cobble from the riverbed.

CSX's request to borrow rock from above the OHWM, disturbing bedrock that is normally underwater.

TDEC and USACE findings of CSX violations during work conducted under the emergency permit.

The need for a proper OHWM and restoration of already destroyed areas.

The use of local rock quarries to support the local economy and protect the environment.

CSX's disturbance of areas outside the railroad easement both below and above the OHWM.

CSX's observed work without permits and inability to make sound environmental decisions.

Flood mitigation concerns for surrounding areas.

Drinking water quality concerns for nearby communities.

Habitat loss for various species.
