MPAA is encouraged to see the Cannabis Control Commission moving forward with a major regulatory overhaul that includes important changes to the Medical Use of Ma*****na Program.

The Commission’s Access to Medical Cannabis Working Group has proposed several reforms that could make the program easier to use, improve patient access, reduce unnecessary barriers, and modernize the medical ma*****na program.

The Massachusetts Cannabis Control Commission on Sept. 17 will begin a series of public meetings to undertake one of the largest efforts to modernize cannabis regulations in Commission history, with topics including cannabis testing protocols, medical ma*****na licensing, and registered agent training up for discussion. In United States v. Hemani, the Supreme Court held that 18 U.S.C. § 922(g)(3) cannot be constitutionally applied to prohibit fi***rm possession based solely on a person’s ma*****na use.

The Court explained that fi***rm restrictions must be grounded in historically supported categories of disarmament, such as individuals shown to be dangerous, and that ma*****na use alone is not sufficient to justify prosecution under 18 U.S.C. § 922(g)(3).

The Supreme Court ruled in favor of Ali Hemani, a Texas man charged with unlawful possession of a gun since he admitted that he regularly smoked ma*****na.
