SHORT TERM RENTALS (AirBnB & VRBO)

Folks,
It is time to let your Council member, in fact all the Council members and the Mayor, your board's position on Short Term Rentals.
The United Neighborhoods of Fort Worth, which is made up of many of the HOAs, Neighborhood Associations, and Neighborhood Alliances, is advocating for keeping the rules as they are now. No STRs in residential neighborhoods. Homeowners can request a rezoning to become a B&B, but they have to go to the Zoning Commission. The neighborhood association and the neighbors within 300 feet would be notified and have a chance to support or oppose the rezoning.
All the research point to this being the best way to protect our individual neighborhoods of all the options.
Some HOAs have provisions that exclude STRs in their declaratory documents. There are some who have adopted policies, drawn up by their lawyers, that prohibit STRs. The downside of this is that the HOA is subject to a law suit to defend those positions. There is a national association backing proponents of STRs and could make it very expensive to defend the declaratory documents or the policies. Also, there is no telling if a judge would uphold those policies or document provisions.
My observation is that mandatory HOAs have the power to at least see that the STR properties are kept up to standard. However, voluntary neighborhood associations do not. Their only protection is through City Ordinance.
Second, we all know we do not have adequate police patrols in our areas to respond to loud parties or disturbances in a timely manner, if at all. The City also does not have the Code Enforcement Officers to be able to enforce the current ordinances and are left investigating the worst of the worst. Until those deficiencies are remedied, the unsavory elements of STRs will disrupt our neighborhoods. (Not all STRs will produce unsavory elements.)
I urge you to encourage your board to pass a resolution supporting Option 1. Current Ordinances and notify the Mayor and Council of your decision.
I urge you to get your residents involved in writing as well. If our voice isn't heard, we will be herded.
