Tax filing season has officially begun! The IRS is now accepting and processing 2024 tax returns. If you don’t have a plan to prepare and file your return, now is the time.

If you can’t afford tax preparation assistance, it’s a great idea to see whether you can have your return prepared and filed for free through VITA! VITA clinics are staffed by highly trained volunteers and have no charge whatsoever for qualifying low-income individuals and families.

What Happened?

The United States Supreme Court on June 28 released its opinion on Loper Bright v. Raimondo, overturning the 40-year-old Chevron doctrine. Chevron provided federal agencies room to interpret ambiguous or unclear laws and required federal courts to defer to these interpretations.


Implications

The Loper Bright decision curtailed the authority of the Internal Revenue Service (IRS) to interpret the laws they enact. Judges will now have the final say on how laws are interpreted and implemented. This is expected to result in more legal challenges and constraints on the IRS in issuing tax guidance and rules.


What This Means For Taxpayers

With potentially more legal challenges to the IRS’s regulations, new tax rules and guidance may take longer. Furthermore, taxpayer uncertainty and complications to IRS tax compliance and enforcement are likely to arise.

Starting next year, the IRS will provide free tax filing software that most taxpayers can use in all 50 states. Following the success and popularity of the federal Direct File pilot, an innovative, restricted trial project which allowed for tax filers from 12 states to submit their tax returns directly with the IRS for free, the IRS announced on May 30 that it will be available permanently starting in the 2025 season.

While Direct File is limited in scope and is intended for taxpayers with relatively simple tax situations, millions of filers will soon be able to easily and safely file their federal taxes directly with the IRS for free, saving our taxpaying community time and money.

The IRS has invited all 50 states and the District of Columbia to partner with them in making Direct File available to ensure that people can file their state tax returns simply and freely.

IR-2024-151, May 30, 2024 — Following a successful filing season pilot and feedback from a variety of partners, the Internal Revenue Service announced today that it will make Direct File a permanent option for filing federal tax returns starting in the 2025 tax season.
