TOPIC: UNDERSTANDING CAUSE OF ACTION IN LAW; The Foundation of Every Successful Case.

CAVEAT: Vigilantibus non dormientibus jura subveniunt; the law aids the vigilant, not the idle. i) Do you know that if your complaint has no cause of action, the court cannot help you no matter how sympathetic your story is?
ii)Do you know that every lawsuit must rest on provable facts; not emotions or assumptions?
iii) Do you know that the first thing a good lawyer checks before filing a case is whether there is a cause of action at all?

THE LEGAL PRINCIPLE; Including the Global Perspective:
Black’s Law Dictionary / General Legal Meaning; Cause of Action: “A group of operative facts giving rise to one or more bases for suing; a factual situation that entitles a person to obtain a remedy in court.” In simple terms, your cause of action is the legal reason plus the facts that allow you to go to court. No cause of action; no case. Nigeria Legal System;
MILAD, Benue State & Ors. v. Abayilo (2001) FWLR (Pt. 45) 602 @ 615 CA - A cause of action is the aggregate of facts constituting the complaint. Julius Berger Nig. Plc v. Omogui (2001) FWLR (Pt. 64) 305 @ 317 SC – The Supreme Court held that a cause of action is the combination of the wrongful act and resulting damage. A-G Federation v. Abubakar (2008) 16 NWLR (Pt.1118) 345 SC (recent principle affirmed): A court cannot assume jurisdiction unless a proper cause of action exists.
BREAKING IT DOWN FOR NON-LAWYERS:
To succeed in court, you must show:
1) There was a wrong done to you.
2) You suffered damage or loss.
3) You have the legal right to sue.
4) Your claims are within time to.

SPECIAL COURT - The prosecution’s first witness in the trial of eight SPLM/A-IO officials on Monday continued presenting an SSPDF report on the Nasir incident, including several video clips of the violence.

Maj. Malual Deng described what he said happened after the fall of Nasir to the White Army, alleging executions and mistreatment of wounded soldiers.

He also told the court that the late White Army commander, Tor Gile Thoan had served as an SPLA-IO officer, and that Kang Makana, who he said captured the garrison - is responsible for the killing of Gen. David Majur.

Deng further detailed government efforts in Juba to involve a third party to evacuate 55 besieged soldiers, including Majur.

He said Dr. Riek Machar provided assurances for the evacuation but testified that those instructions were not followed on the ground, leading to violence during the attempts.

The court adjourned after its 24th session and is expected to resume on Wednesday, Nov. 26, for further testimony and defence’s cross-examination of the witness.

𝐉𝐮𝐛𝐚, 𝐍𝐨𝐯𝐞𝐦𝐛𝐞𝐫 𝟏𝟗, 𝟐𝟎𝟐𝟓 –President Salva Kiir Mayardit has directed the newly appointed government officials to exert their efforts and work tirelessly to relieve the hardships facing the population. The president was speaking during the swearing-in ceremony held in Juba on Wednesday.

‎The officials sworn in included Vice President Dr. James Wani Igga, Presidential Envoy to the Middle East, Ambassador Monica Achol Abel Aguek, Minister of Information Ateny Wek Ateny, Minister of Justice Michael Makuei Lueth, Minister of Roads and Bridges Peter Lam Both, Minister of Environment and Forestry Mabior Garang de Mabior, Governor of Central Equatoria State Emanuel Adil Anthony, and Inspector General of Police Gen. Said Chawul Lom.

‎President Kiir urged the officials to work around the clock and focus their full energy on improving service delivery and tackling social and economic challenges affecting citizens.

The President entrusted new Presidential Envoy to the Middle East with the responsibility of fostering cordial relations, ensuring the realisation of South Sudan’s national interests through diplomatic means.

‎Addressing the new Minister of Justice, the President gave a clear directive to prioritise reforms in the justice sector. “You must address the backlog of cases in the judiciary and work toward improving the delivery of justice to our people,” Kiir emphasised.
‎
‎The President also tasked the Governor of Central Equatoria, Emmanuel Adil Anthony, with enhancing security in the state, saying it is vital to ensure the safety of citizens and their property.
‎
‎The Head of State said he is optimistic that the new officials will bring renewed energy to the administration's efforts, which are directed towards restoring confidence and improving conditions across the country.
