If the child was 15 years old (on his/her birthday) or below
Under the Juvenile Justice and Welfare Act (RA 9344, as amended by RA 10630), a child who is 15 years old or below at the time of the commission of the offense is exempt from criminal liability.
No exceptions.
No matter how serious the act.
Thus, if one of the reported suspects was only 14 years old at the time of the shooting, he cannot be criminally convicted.
However, exempt from criminal liability does not mean wala nay mahitabo.
This is where the social worker immediately comes in.
Upon taking custody of the child, the law requires the intervention of a licensed social worker from the Local Social Welfare and Development Office (LSWDO) within the prescribed processing period.
The social worker shall:
* Conduct a psychosocial assessment;
* Prepare a Case Study Report;
* Develop an individualized Intervention Program;
* Coordinate counseling and psychological services;
* Facilitate educational and community-based interventions; and
* Monitor the childβs compliance and progress.
The goal is not punishment, but rehabilitation and reintegration.
Despite the childβs exemption from criminal liability, the parents may still be held civilly liable for damages.
