WHEREAS, Section 16 of the Local Government Code mandates all local government units to exercise the powers for the efficient and effective governance essential to uphold the general welfare, especially the health and safety of its people;
WHEREAS, Article II, Section 13 of the Constitution provides that the State recognizes the vital role of the youth in nation-building and shall promote and protect their physical, moral, spiritual, intellectual, and social well-being. It shall inculcate in the youth patriotism, nationalism, and encourage their involvement in public and civic affairs;
WHEREAS, in order to ensure the safety of all minors from accidents and other untoward incidents that usually happen during the nighttime, it is imperative to regulate their movements;
NOW, THEREFORE, I, LEMUEL T. REYES, City Mayor of the Island Garden City of Samal, by virtue of the powers vested in me by law, do hereby order the curfew on all minors (below eighteen [18] years old) in the Island Garden City of Samal.
Section 1. Curfew Hours.
All minors/children below eighteen (18) years old shall be prohibited to loiter, stray, or wander outside of their house, dormitory, or boarding house from 10:00 oโclock in the evening until 5:00 oโclock in the morning.
Section 2. Exemptions.
Minors may be allowed outside their house, dormitory, or boarding house under the following circumstances:
โข When accompanied by their parents or guardians;
โข When the minor is involved in emergency situations or unforeseen circumstances such as but not limited to fire, calamities, disasters, or accidents in order to save lives;
โข When the minor is engaged in an employment or school class and is returning home from such activity or class without detour or stop;
โข When the child is attending a school, religious, or civic-sponsored activity provided the said activity is supervised by adults and the minor is returning home from such activity without detour or stop.
Section 3. Implementing Agencies.
The Philippine National Police (PNP) or Punong Barangays of respective barangays shall take charge in the implementation of this Order and shall observe the procedure under RA No. 9344, otherwise known as the Juvenile Justice and Welfare Act of 2006.
Section 4. Obligation of Parents or Guardians.
The parents or guardians who are in actual custody of the minor must supervise the activities of minors and see to it that the latter is already at home before the curfew hours.
Section 5. Penalty Clause.
Violations of this Order shall be penalized in accordance with City Ordinance No. 1999-09, otherwise known as โAn ordinance imposing the observance of curfew hours for all minors in public places in the Island Garden City of Samalโ and other applicable laws.
Section 6. Separability Clause.
If any portion or provision of this Order will be declared inconsistent or invalid, the other portions or provisions hereof, which are not affected thereby, shall continue in full force and effect.
Section 7. Effectivity.
This Order shall take effect today, October 19, 2025, and shall be in full force and effect until revoked or modified.
