CONGRATULATIONS TO OGALE AND BILLE COMMUNITIES IN THE NIGER DELTA.

DETAILS BELOW:
1. Whether Shell can be held liable for legacy pollution sites if they have failed to clean up.
YES THEY CAN
2. Whether Shell can be held liable for damage resulting from oil theft from pipelines, known as “bunkering,” or for the waste produced as a result of illegal artisanal refining of spilled or stolen oil if they have failed to protect their infrastructure.
YES THEY CAN, IF SHELL FAIL/ FAILED TO ADEQUATELY PROTECT THE INFRASTRUCTURE, AND / OR WHERE THERE IS EVIDENCE SHELL STAFF HAVE BEEN COMPLICIT
3. Whether oil pollution by a private company can be a violation of the communities’ fundamental human rights under the Nigerian Constitution and African Charter on Human and People’s Rights.
THIS IS A MATTER FOR THE NIGERAN COURTS, NOT AN ENGLISH JUDGE, BUT THERE IS MORE NUANCE TO THIS

ADDTIONALLY TO THE 3 ABOVE:
The judge found that Shell plc as the parent company can still be liable for spills from pipelines and therefore claims against Shell plc will proceed.
