HUMAN RIGHTS UPDATE:
PROCLAMATION OF STATE OF EMERGENCY MAY NOT BE MORALLY DESIRABLE BUT ITS’ LEGAL AND CONSTITUTIONAL ONCE THE NATIONAL PASS A RESOLUTION SUPPORTED BY TWO THIRD MAJORITY APPROVING IT.

The powers of the President to issue a proclamation of state of emergency is not absolute but subject to the National Assembly passing a Resolution supported by two-third majority of all the members of each House of the National Assembly approving the Proclamation, as provided by Section 305(6)(b), of the Constitution of Federal Republic of Nigeria 1999(As Amended).
Section 305(6)(b), of the Constitution further goes on to state that the approval of the National Assembly must be done within two days when the National Assembly is in session or within ten days when the National Assembly is not in session. The implication of this is that attention is now shifted to the National Assembly, where the constitutional requirement for two-third majority of all the members of each House of the National Assembly is needed for the Proclamation to be sustained.
So it is inchoate at this point to condemn the issuance of the proclamation.
There are very few cases that have come up before the Supreme Court of Nigeria in respect of Declaration of State of Emergency in parts of the country hence the need to have recourse to these cases.
Aftermath of the Declaration of the State of Emergency in the western Region of Nigeria by the Governor-General-in-Council, the Supreme Court of Nigeria in the newly independent state Nigeria, was saddled with question on the legality of the action.
The Supreme Court in One of the cases; F.R.A. WILLIAMS V. MAJEKODUNMI (NO.2) (1962) LPELR-25044(SC) (Pp. 10 paras. A) The Chief Justice of the Federation Honorable Justice Adetokunbo Ademola J.S.C, stated thus:
"That a state of public emergency exists in Nigeria is a matter apparently within the bounds of Parliament, and not one for this Court to decide. Once that state of emergency is declared, it would seem that according to the Constitution, it is the duty of Government to look after the peace and security of the State, and it will require a very strong case against it for the Court to act."
It should be noted that one of the three questions considered by the Supreme Court was “Whether the Emergency Powers Act, 1961, under which the regulations were made was ultra vires the Parliament because it purports to delegate or abdicate the legislative powers of Parliament to the Governor-General-in-Council and the said Act also purports to authorise the Governor-General-in-Council to delegate or abdicate those powers to the Administrator”.
So the proper approach or advocacy is for interested or aggrieved parties to lobby or pressurized the National Assembly not to pass a resolution approving the state of emergency. The citizens should be abreast with the law and it is assumed that every citizen do have a copy of the Constitution.
The highest power regarding the issuance of Proclamation of State of Emergency lies in the National Assembly hence the stringent requirement of Resolution of two-third majority of members of each House of the National Assembly. The Courts have little or nothing to do in this regard.
If the National Assembly supported it, then it becomes legal and constitutional.
The Supreme Court in ADEGBENRO V. AG OF THE FEDERATION & ORS (1962) LPELR-25118(SC) (Pp. 12-13 paras. F) held as follows: "...it is not for this Court to go outside the provisions of Section 65(3) of the Constitution of the Federation defining emergency. It reads: (3) In this Section "period of emergency" means any period during which- (a) The Federation is at war; (b) there is in force a resolution passed by each House of Parliament declaring that a state of public emergency exists; or (c) there is in force a resolution of each House of Parliament supported by the votes of not less than two-thirds of all the members of the House declaring that democratic institutions in Nigeria are threatened by subversion." Per ADEMOLA ,J.S.C .
So we look forward to what happens at the National Assembly in the next two days.
