How to Legally Evict a Tenant from a Property in Nigeria
Under Nigerian law, landlords are prohibited from using self-help to evict tenants. The eviction process must follow a legal procedure to be valid. This principle was upheld by the Nigerian Supreme Court in the case of Eloichin (Nigeria) Ltd v Mbadiwe (1986) 1 NWLR (Pt. 14) 47, where Justice Obaseki noted:

“Where the landlord brushes aside the necessity to obtain an order of court for possession and jettisons the rule of law, enters the premises and takes possession, he has invaded and committed an infraction of the rights of the tenant and renders himself liable in trespass.”
To legally evict a tenant in Nigeria, the following steps must be taken:

1. Serve a Notice to Quit

The first step is to provide the tenant with a Notice to Quit of the appropriate length, depending on the type of tenancy:

Tenant at will: 1 week’s notice
Monthly tenant: 1 month’s notice
Quarterly tenant: 3 months’ notice
Half-yearly tenant: 3 months’ notice
Yearly tenant: 6 months’ notice
In the case of a fixed-term tenancy, no Notice to Quit is needed, as the tenancy automatically ends when the specified period expires.

2. Serve a Notice of Owner’s Intention to Recover Possession

If the tenant does not vacate after the Notice to Quit expires, the landlord must serve a Seven-Day Notice of Owner’s Intention to Recover Possession. This notice applies to both fixed-term and periodic leases.

3. File a Court Action

If the tenant still refuses to vacate after the Seven-Day Notice, the landlord can file a lawsuit in court. The court proceedings may include claims for possession, unpaid rent, and other related damages.

4. Enforce the Court Judgment

If the court grants a favorable judgment and the tenant fails to vacate the property by the date specified, the landlord can enforce the judgment through court bailiffs.

Alternative Dispute Resolution (ADR)
Landlords also have the option to pursue Alternative Dispute Resolution (ADR), such as mediation or arbitration, to resolve eviction matters amicably.
