The Majority isn't always right.

GEFOINET’s View after the review of our Legal Team of the full Opinion in the contempt proceeding against Prophet Key by the Supreme Court of Liberia.

GEFOINET acknowledges the Supreme Court’s constitutional authority to protect its dignity and the integrity of the judiciary. However, two critical legal concerns arise from the ruling:

1. Clarity on Contempt vs. Criminal Offense:

Under Liberia law, contempt powers derive from the Judiciary Law (Title 17) and the Court’s inherent authority to punish acts that obstruct justice or undermine judicial proceedings. For speech to constitute criminal contempt, it must show a clear and present danger to the administration of justice—not merely offensive or insulting expression made outside active court proceedings.
The ruling appears insufficiently explicit on how the Facebook insults legally satisfied this threshold.

2. Excessiveness of the Six-Month Sentence:
Contempt sanctions must be summary, corrective, and proportionate. Comparatively:

- Penal Law (Title 26), Section 17.3 — Disorderly Conduct,

- Misdemeanor (4th Degree)
- Maximum imprisonment: 30 days
- Lesser public order and speech-related misdemeanors carry penalties far below six months.

While contempt is sui generis (unique), Liberian sentencing practice still follows the principle of proportionality. A six-month custodial sentence, plus compulsory public apologies, appears punitive rather than corrective, thus raising concerns of excessiveness relative to analogous statutory offenses.

Conclusion
GEFOINET maintains that:

- The Court must clearly distinguish moral insult from legal contempt. Halfway precedence harms then heals.
- Contempt penalties should align with Liberia’s broader misdemeanor sentencing framework. This is key.
- Judicial authority is best preserved where sanctions are law-grounded, proportionate, and transparently reasoned.

GEFOINET 2025 Impact & Call for 2026 Program Priorities:

In 2025, GEFOINET, in partnerships with donors supported over 40 survivors of Sexual and Gender-Based Violence (SGBV) with medical treatment, feeding, and transportation. We also assisted 1,200 women to understand their Sexual and Reproductive Health Rights (SRHR), resulting in over 200 new family planning users. Additionally, we supported two women who underwent C-sections and were partially abandoned by their spouses.
GEFOINET further collaborated with the Liberia National Police/WACPS to support the arrest and prosecution of SGBV perpetrators.

Summary of Program focus in 2025:
SRHR – 50%
SGBV – 30%
Rule of Law – 20%

Looking ahead to 2026, GEFOINET will dedicate 40% of its programming to Access to Information and the Freedom of Information Law.

Millennium Challenge Corporation (MCC) to Deploy a Team to Liberia Soon to Identify Sectors for Possible MCC Support

The Board of Directors of the Millennium Challenge Corporatiin (MCC) met yesterday, August 21, 2025, to discuss the results of the Foreign Assistance Review, which was conducted by the US State Department. At the meeting, the MCC Board decided that a decision on Liberia's continued elgibility for a second Compact will be made in December 2025 at the MCC regular Board meeting.

In a letter dated Friday, August 22, 2025 addressed to Liberia's Minister of Finance & Developpment Planning Augustine Kpehe Ngafuan, MCC Acting Vice President for the Department of Compact Operations, Mr Jason Small, informed the Minister that the "MCC's continuing engagement on development of a Compact with Liberia will focus on areas that can inform the Board's December deliberations. As a next step, MCC will work with you to identify sectors that a Compact could focus on to support economic growth in Liberia while offering opportunities for US business engagements and other mutual benefits."

Acting VP Small then informed Minister Ngafuan that the "MCC intends to send a team to Liberia to advance these discussions at a time that is mutually convenient. Our team will be in touch with further details."

In his letter, Mr. Small also thanked Minister Ngafuan for taking the time to visit MCC Headquarters in Washington DC in July 2025 and for the strong partnership that currently exists between the MCC and the Liberian government. He stressed that MCC is proud of the work that the MCC and the Liberian people accomplished together through the first MCC compact with Liberia.

In response, Minister Ngafuan thanked Mr. Small for the update and extended President Boakai and the Liberian government's deep appreciation to the MCC Management and the US government for the strong support to Liberia's development. Minister Ngafuan heartily welcomed the MCC's decision to field a team to Liberia to work with the Liberian government to identify sectors that could possibly benefit from MCC support through a possible second Compact.

Minister Ngafuan informed Mr. Small that the Liberian government avidly anticipates the visit of the MCC team in the shortest possible time.
