Supreme Court Initiates Suo Motu Proceedings on NCERT Textbook

In In Re: Social Science Textbook for Grade 8 (Part-2) Published by NCERT & Ancillary Issues, 2026 SCC OnLine SC 318, the Supreme Court of India (26 February 2026) took suo motu cognizance of a Grade 8 NCERT Social Science textbook chapter discussing “Corruption in the Judiciary.”

The Court expressed concern that the chapter:

• Referred to complaints against the judiciary
• Cited statements of a former Chief Justice regarding transparency
• Suggested corruption is experienced at various judicial levels
• Did not sufficiently highlight judicial contributions, including protection of constitutional principles

The Court indicated that, if deliberate, the matter could fall within criminal contempt under the Contempt of Courts Act, 1971.

Key Directions:

• Show-cause notices to the Education Secretary and NCERT Director
• Immediate suspension and seizure of all physical and digital copies
• Blanket ban on further publication or dissemination
• Production of records relating to drafting and approval

The case raises important constitutional questions on:
– Institutional dignity vs democratic critique
– Academic freedom and curriculum autonomy
– Scope of contempt jurisdiction

Can a High Court simply “rubber-stamp” a Trial Court order under the SC/ST Atrocities Act?

The Supreme Court has now given a clear answer: No.

In Dr. Anand Rai v State of Madhya Pradesh (10 February 2026), the Court clarified the true scope of appeals under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

🔎 What did the Court say?

An appeal under Section 14-A is a statutory first appeal.

That means:

✔ The High Court is a court of fact and law
✔ It must independently evaluate the evidence
✔ It cannot mechanically affirm the Trial Court
✔ It must show real judicial application of mind

In this case, charges under the Atrocities Act were framed even though witness statements did not specify the alleged caste-based slurs. The High Court affirmed that order without proper scrutiny.

The Supreme Court intervened and quashed the charges under the Special Act, holding that the essential prima facie ingredients were absent.

⚖ Why This Matters

This decision sends a powerful message:

• Special statutes require strict ingredient-based scrutiny
• Appellate courts cannot function as passive endorsers
• Procedural safeguards apply with full force even in sensitive prosecutions

The ruling strengthens appellate accountability and reinforces principled criminal adjudication.

Minimum Wages for Domestic Workers: A Constitutional Question Remains

On 29 January 2026, the Supreme Court of India disposed of a petition seeking recognition of minimum wages for domestic workers, observing that the matter falls within the domain of the legislature and the executive.

While institutional limits must be respected, the constitutional concern remains unresolved.

Work without fair wages raises serious questions under Articles 14, 21, and 23—equality, dignity, and freedom from forced labour. Domestic workers, largely women from marginalised communities, continue to remain outside uniform labour protection.

Minimum wages are not a policy favour. They are a constitutional minimum.

A fair society must ask: how long can dignity wait?

🚨 U.S. Intervention in Venezuela = Clear Violation of International Law

Power does not give legal permission to interfere in another country’s government.

Under the UN Charter and international law:
❌ No State can violate another State’s sovereignty
❌ Use of force is illegal without UN Security Council approval or self-defence after attack
❌ Regime change, political pressure, and coercive sanctions are unlawful intervention
❌ Collective economic punishment of civilians is not humanitarian — it is illegal

There is no legal right to impose democracy by force.
International law protects peoples, not powerful governments.

If these rules fail, no country is safe.

When the State demolishes a house, it does not demolish a structure — it demolishes a life.

On 20–21 December 2025, families in Kogilu, Bengaluru, woke up not to a notice, but to bulldozers.
Children lost their beds, elders lost shelter, and working families lost the only security they had — a home.

Law is meant to protect the vulnerable, not terrorise them.
