🚨 Supreme Court Women Lawyers Association Condemns Misogynistic Remarks by Justice Markandey Katju

The Supreme Court Women Lawyers Association (SCWLA) has issued a firm condemnation of the misogynistic remarks made by former Supreme Court judge, Justice Markandey Katju.

Such statements, especially coming from individuals who have held positions of immense responsibility and influence, perpetuate harmful stereotypes and undermine the fight for gender equality within the legal profession and beyond.

As members of the legal community, we must collectively stand against regressive narratives and reaffirm our commitment to fostering a profession and a society built on dignity, respect, and equality for all genders.

The law is not just about justice in the courtroom, but also about ensuring that every voice is heard without prejudice or bias. Remarks that demean or trivialize women have no place in the legal discourse of a progressive democracy.

✊ It is time we continue to call out such behavior, strengthen accountability, and work towards a future where respect is the norm, not the exception.

POSH Compliance on the Rise 📈

India’s top 30 companies saw a 6.2% increase in sexual harassment complaints in FY25 which is a clear sign that employees are becoming more confident in raising their voices and seeking redressal under the POSH Act.

•The rise highlights greater awareness and trust in organizational redressal mechanisms.
•However, the 21% jump in pending cases is a pressing concern that calls for stronger IC efficiency and timely resolution.
•Banks and IT firms reported the majority of cases with TCS leading in numbers.

👉 The takeaway is that rising complaints are not always bad news. They reflect courage, awareness, and the effectiveness of compliance structures. What is crucial now is ensuring speedy, fair, and sensitive resolutions to strengthen employee trust further.

Supreme Court Orders Nationwide POSH Compliance Check 🚨

On 12 August 2025, the Supreme Court directed an extensive district-wise survey to be completed within 6 weeks to check compliance with the POSH Act by employers across all Government and Private institutions in the country.

The Court has instructed:
• Labour Commissioners in each district and Chief Labour Officers of each state to supply details of all registered entities
• Information on the constitution of the Internal Committee (IC) to be shared with the Deputy Commissioner or equivalent officer for survey purposes

This is a critical step towards ensuring workplaces truly implement the SHWW (POSH) Act, 2013, safeguarding employees against sexual harassment and creating safe, respectful work environments.

🚨 Depriving Women Advocates of POSH Protection: A Disturbing Judicial Interpretation ⚖️

❓What happened?
The Bombay High Court held that Bar Councils are not “employers” of advocates and hence, not bound to follow the POSH Act for sexual harassment complaints by practicing women advocates.

❓Why is this problematic?
Because it leaves women in litigation advocates, interns, clerks without any formal mechanism to report harassment.
No employer = No Internal Committee = No POSH Protection.

❓But isn’t harassment still harassment - job or no job?
Exactly. Sexual harassment is about power, not payroll.
It doesn’t vanish just because there’s no appointment letter.

📌 So what now?
This judgment exposes a legal vacuum. It’s a wake-up call for legislative reform to expand POSH’s definition of workplace and employer, especially for the legal profession, where informal structures dominate.

💬 What message are we sending?
That women lawyers are good enough to fight for justice, but not worthy of basic workplace safety?

🛡️ The POSH Act was meant to protect every working woman.
It’s time the law keeps up with reality. Let’s push for a more inclusive interpretation one that doesn’t leave women in robes, unprotected.

📣 Raise your voice. Advocate for change. Because the law should protect those who protect it.

She Set Herself on Fire to Be Heard - We Must Carry the Weight of Her Silence

🕯 Balasore, Odisha.
A 19-year-old B.Ed student.
Sexually harassed by her professor, the Head of Department.
She filed a complaint. No action. No protection.
So she did what no one should ever have to do
She set herself on fire.
90% burns. 3 days of agony.
And then - silence.

🚨 This is not a failure of the law.
It is a failure of:

❌ Enforcement
❌ Empathy
❌ Ethics
❌ Every system meant to protect her

What was the Internal Complaints Committee (IC) doing?
Where was the college administration?
Why did it take her death for action to begin?

📜 The Law Exists - But Only On Paper?
🧷 The POSH Act, 2013 clearly mandates:
🔹 Every institution must have a functioning ICC
🔹 Complaints must be addressed confidentially, fairly, and swiftly
🔹 Students can file a complaint within 3 months

But here’s the reality:

⚠️ ICCs that don’t respond
⚠️ Victims met with disbelief
⚠️ Institutions more worried about reputation than justice

This isn’t a procedural lapse - it’s institutional betrayal.

💔 Every Woman Who Speaks Up Risks More Than Just Her Career
She risks:
🔸 Blame
🔸 Character assassination
🔸 Social silence
🔸 Emotional exhaustion

And when she stays quiet? She’s asked why she didn’t speak up earlier.

How do we expect anyone to fight a system that’s stacked against her?

👩‍⚖ As a woman, and a human being, we ask:
⚖️ Why aren’t ICCs trained and sensitized?
⚖️ Why are we protecting predators, not victims?
⚖️ Why does justice come only after tragedy?

Let’s be honest - the most unsafe places for women are often the ones meant to empower them.

✊ Let Her Death Ignite Change - Not Disappear Into Dust
A girl should never have to choose death over dignity.
But she did.
And now we must carry the weight of her silence.
Not with words alone but with action, policy, and empathy.
