The Supreme Court on September 9 held that homebuyers stuck in housing projects facing insolvency shall be entitled to possession if their claim has been verified and admitted by the resolution professional in the list of financial creditors.

The Supreme Court ruled that homebuyers in insolvency cases are entitled to possession if their claims are verified, addressing injustices faced by individuals.

CBI Raids In Delhi-NCR Builder Scam | Thousands Of Homebuyers Cheated In Subvention Plan | News9

Thousands of Delhi NCR homebuyers remain stuck in an endless wait as projects remain unfinished and funds allegedly siphoned off. Acting on Supreme Court directions, the CBI has registered cases against a suspected nexus between banks and builders. Raids were carried out across NCR in connection with the subvention plan scam. Victims include buyers of Supertech and Jaypee Sports City projects — Kove and Kassia — who say they’ve lost their savings and are still without homes.

Meeting of JP Sports City Home Buyers Regarding Ongoing Supreme Court Case Concluded

On 17th August 2025, a meeting of the JP Sports City Welfare Association was convened at JP Sports City, Sector 25, Yamuna Expressway Authority, near Formula 1 Sports Complex, in which around 200 to 250 people participated.

It is worth noting that some time back, a Supreme Court bench had ordered CBI and Enforcement Directorate (ED) investigations against Jaypee Associates Limited, over 28 other builders, and more than 10 banks. This investigation concerns an alleged embezzlement of around ₹35,000 crore by the builders and banks.

In light of these issues, the buyers organized today’s meeting at the temple premises of Yamuna Sports City, which was also attended by the Home Buyers’ Society Management and the lawyer representing home buyers in the Supreme Court.

Recently, in this matter, the Allahabad High Court cancelled the lease of Jaypee Associates Limited and returned the land to the Yamuna Expressway Authority.

The office bearers of the Home Buyers’ Association, Mr. Sunil Sharma, Mr. JP Maurya, Mr. Rudraksh Khandelwal, Mr. Kuldeep Sisodia, Mr. Gaurav Sharma, and Mr. Mohar Singh, were present at the meeting.

Mr. Sunil Sharma said that the buyers fully trust the Supreme Court and are confident that the decision will provide complete relief to those home buyers who have been struggling without homes for the last two decades. He further expressed hope that their homes will be constructed and handed over promptly, and that strict legal action will be taken against the builders and banks. The Home Buyers also decided to submit a memorandum to the CEO of Yamuna Authority, demanding protection of their interests and early completion of the project.

The Association’s lawyer, Mr. Abhishek Singh, answered all the legal questions of the buyers.

जेपी स्पोर्ट्स सिटी के घर खरीदारों की सुप्रीम कोर्ट में चल रहे केस को लेकर मीटिंग संपन्न

आज दिनांक 17 अगस्त 2025 को जेपी स्पोर्ट्स सिटी, सेक्टर 25, यमुना एक्सप्रेसवे अथॉरिटी निकट फॉर्मूला 1 स्पोर्ट्स कंपलेक्स के प्रांगण में जेपी स्पोर्ट्स सिटी वेलफेयर एसोसिएशन की एक मीटिंग आहूत की गई जिसमें लगभग 800 से 850 लोगों ने भाग लिया।

जेपी स्पोर्ट्स सिटी का प्रोजेक्ट, जेपी एसोसिएट्स लिमिटेड ने वर्ष 2009 के आसपास लॉन्च किया था जिसमें करीब 4,500 खरीददारों ने फलैट और प्लॉट बुक कराए थे। लेकिन लगभग 20 साल बीत जाने के बावजूद भी किसी भी खरीददार को ना ही फ्लैट मिला, ना घर मिला और ना ही प्लॉट मिला।

इस मामले को लेकर इस समय खरीददार इलाहाबाद हाई कोर्ट में केस जीतने के बाद भी पुनः सुप्रीम कोर्ट में अपने घर और मकान के लिए केस लड़ रहे हैं।

विदित हो के कुछ समय पूर्व सुप्रीम कोर्ट की एक बेंच ने जेपी एसोसिएट्स लिमिटेड सहित 28 से भी ज्यादा बिल्डरों और 10 से भी ज्यादा बैंकों के ऊपर सीबीआई और प्रवर्तन विभाग ED की जांच चलाई हुई है। इस मामले में करीब करीब 35,000 करोड रुपए की गबन की जांच बिल्डर और बैंकों पर चल रही है।

इसी मामलों को लेकर आज खरीददारों ने यमुना स्पोर्ट्स सिटी के मंदिर प्रांगण में एक मीटिंग बुलाई जिसमें होम बायर्स सोसायटी मैनेजमेंट और सुप्रीम कोर्ट में होम बायर्स का केस लड़ रहे वकील भी शामिल हुए.

इस मामले में हाल में ही इलाहाबाद हाईकोर्ट में जेपी एसोसिएट्स लिमिटेड की लीज कैंसिल करके जमीन वापस यमुना एक्सप्रेसवे अथॉरिटी को दे दी है।

होम बायर्स एसोसिएशन के पदाधिकारी श्री सुनील शर्मा, श्री जेपी मौर्य, श्री रुद्राक्ष खंडेलवाल, श्री कुलदीप सिसोदिया, श्री गौरव शर्मा श्री मोहर सिंह मौजूद रहे।

श्री सुनील शर्मा ने कहा कि हम लोग सुप्रीम कोर्ट के ऊपर पूरा भरोसा रखते हुए आश्वस्त है कि जो भी फैसला सुप्रीम कोर्ट की ओर से आएगा उसमें उन घर खरीददारों को जो पिछले दो दशक से घर के अभाव में भटक रहे हैं, उन्हें पूरी राहत मिलेगी और उनके घर बनाकर तुरंत दिए जाएंगे और बिल्डर और बैंकों के ऊपर जायज कानूनी कार्रवाई की जाएगी। होम बायर्स ने यमुना अथॉरिटी के कैसियो सीईओ को भी के ज्ञापन देने का फैसला लिया होम वायर्स यमुना अथॉरिटी से उनके हित की रक्षा और प्रोजेक्ट के कंप्लीशन जल्द से जल्द हम इस बारे में ज्ञापन देंगे।

समिति के वकील श्री अभिषेक सिंह ने सभी खरीदारों के कानूनी सवालों का जवाब दिया।

Today, the matter was heard in the Supreme Court. A fresh application was filed by the suspended director of Jaiprakash Associates Limited, which required more time for filing a reply. As a result, the Supreme Court has scheduled the next hearing for August 6.

The Supreme Court also directed the Resolution Professional of Jaiprakash Associates Limited (JAL) to provide all necessary documents to the Yamuna Authority before the next hearing.

Currently, the agency appointed by the Yamuna Authority—Currie & Brown—has completed approximately 80% of their report assessing the projects. This includes details such as the extent of construction completed, the remaining work, and the estimated budget required to complete the project.

They are also evaluating critical aspects like the structural integrity of the buildings through necessary tests. This process is time-consuming but essential. Without this report, it is not possible to determine whether the buildings need to be demolished and reconstructed or if the existing structures can be retained and construction resumed.

Currie & Brown is expected to receive additional information from Jaiprakash Associates Limited. The matter will be heard in greater detail on August 6, 2025, and we hope to have a clearer picture of the possible outcomes at that time.

आज सुप्रीम कोर्ट में इस मामले की सुनवाई हुई। जयप्रकाश एसोसिएट्स लिमिटेड के निलंबित डायरेक्टर द्वारा एक नई याचिका दायर की गई, जिसके लिए जवाब दाखिल करने हेतु अधिक समय की आवश्यकता बताई गई। इस कारण, सुप्रीम कोर्ट ने अगली सुनवाई की तारीख 6 अगस्त निर्धारित कर दी है।

सुप्रीम कोर्ट ने जयप्रकाश एसोसिएट्स लिमिटेड (JAL) के रेजोल्यूशन प्रोफेशनल भुवन मदान को निर्देश दिया है कि वे अगली सुनवाई से पहले यमुना अथॉरिटी को जेपी स्पोर्ट्स सिटी प्रोजेक्ट से सम्बंधित सभी आवश्यक सूचनाएँ और डाक्यूमेंट्स प्रदान करें।

वर्तमान में यमुना अथॉरिटी द्वारा नियुक्त एजेंसी, करी एंड ब्राउन, परियोजनाओं का असेसमेंट करते हुए लगभग 80% रिपोर्ट तैयार कर चुकी है। इस रिपोर्ट में यह असेसमेंट किया गया है कि कितना निर्माण कार्य हो चुका है, कितना कार्य शेष है और परियोजना को पूरा करने के लिए कितना बजट आवश्यक होगा।

वे फ्लैटों की इंफ्रास्ट्रक्चर की मजबूती (इंटेग्रिटी) की जांच जैसे महत्वपूर्ण पहलुओं का भी असेसमेंट कर रहे हैं, जोटाइम कंज्यूमिंग प्रोसेस है लेकिन अत्यंत आवश्यक है। इस रिपोर्ट के बिना यह तय करना संभव नहीं है कि बिल्डिंग को तोड़कर दोबारा बनाना पड़ेगा या वर्तमान स्ट्रक्चर में ही निर्माण कार्य जारी रखा जा सकता है।

करी एंड ब्राउन को जयप्रकाश एसोसिएट्स लिमिटेड से कुछ अतिरिक्त जानकारी प्राप्त होने की संभावना है। यह मामला 6 अगस्त 2025 को विस्तार से सुना जाएगा और उस समय हमें संभावित निष्कर्षों को लेकर बेहतर स्थिति का अनुमान मिल सकेगा।

Recently, our Executive Committee members had a meeting with YEIDA CEO, Shri Arun Vir Singh, to discuss several important matters concerning the welfare and interests of the homebuyers in our society.

During the meeting, we formally presented a detailed demand letter on behalf of all the homebuyers, highlighting our key concerns, pending issues, and expectations regarding the development of the township.

Shri Arun Vir Singh listened attentively and acknowledged the genuine concerns raised. He assured us that, in the event the Supreme Court verdict is in favour of YEIDA, the authority will make every effort to fast-track the development of the project and resolve long-standing issues faced by the residents.

This meeting marks a positive step forward in our continued efforts to safeguard the interests of our community and ensure timely development and delivery.
