Hi Everyone,
I put my name down as to be on the board of directors for Cois na hAbhainn in 2023 which is why I was emailed by M&C last week with the news of them terminating their contract with us.
Here is a copy of the minutes of AGM 2023 as well as a copy of M&Cs letter of engagement with Cois na hAbhainn Mngt Co.
M&C are/were engaged by the Owners Management Company – not the developer. I do not know who the owner management company is.
In the contract, you will note at item #7 the duration of the contract is outlined from 2022 – 2025. The owners Management Company are only permitted to engage in any contract for a maximum of a three year period in line with the MUD act. Unfortunately, this does not mean that the 3 year duration is fixed- at point 11 you will note that the contract can be terminated at any time by giving 4 weeks’ notice.
We can request a copy of the books and records within a 4 week timeframe however (in the interests of fairness and allowing the members and the board the opportunity to seek a new agent) it has been suggested that this happens at the end of the year.
For M&C, as the company year end has now completed at 31/10/24, the service charges for 01.11.2024 – 31.10.2025 have yet to be agreed. They have been set at the same level for the last number of years – IE 300 is invoiced out, but if members pay within the calendar year, then they actually only need to pay 150/unit.
M&C have advised the same again for the forthcoming period. However this is of course for the members to decide upon.
As you have seen from the notices I dropped in yesterday, I would hope that we can have a meeting w/c 25/11. I will try to set up a poll either on Facebook or Whatsapp to get a consensus. I could also organise a Zoom/teams meeting if you would prefer.
I'm happy to contact a venue (I am thinking Tuar Ard or the Grand hotel). In the meantime I'll try find a few other property management companies.
Please note, I am not particularly good at dealing with contracts etc. so I would appreciate any help that you can offer me in the meantime.
