PRIVATE LANDOWNERS GIFTING LANDS

We have been reliably informed that a private landowner has agreed to "GIFT" a portion of their land to a Maya village in Toledo, under the expectation that the Government of Belize (GoB) will compensate them for it.

While every private landowner has the absolute legal right to gift or surrender all or part of their property, doing so under these circumstances carries massive financial and legal risks. If you choose to proceed based on unwritten assumptions, do so at your own peril and note that Toledo Private and Lease Landowners Ltd will not be able to assist you or advocate for you.

GoB has not yet determined or finalized a framework on how it will deal with private landowners who willingly surrender their land to Maya Customary Land. Therefore, the Government of Belize will have zero legal obligation to compensate you. A gift is a gift.

Legally, a voluntary transfer is viewed strictly as an uncompensated gift.

By making this decision completely voluntarily, you heavily prejudice any legal or financial claims you may want to make at a later date. Once you willingly give up your property, you permanently lose your legal leverage and your right to demand fair compensation.

If you expect compensation from the government, do not hand over your land based on an assumption or an informal promise. Any compensation mechanism must be legally structured and signed BEFORE any property changes hands.

Protect your property rights and stay informed.
