Another FLPA Retreat is behind us, and we’re still feeling it.

Over the past few days, Queensland’s family law community came together in the way it does best sharing knowledge, swapping stories, and reminding each other why this work matters.

The rooms were full. The conversations were rich. And somewhere between the CPD sessions and the dinner table, something that’s hard to put into words happened: people reconnected with their community, and with the deeper sense of purpose that brings us all to this profession.

None of it happens without the people who make it what it is.

NOTICE TO BEWARE OF FALSIFIED TEST RESULTS

A number of practitioners have reported to FLPA the increasing use of falsified drug and alcohol test results in proceedings, often only picked up by chance.

These false results look extremely similar to the real results, but with the relevant numbers or positive test results replaced by outcomes in an acceptable range.

The ability to create false results has apparently been made much easier by the use of Artificial Intelligence, and members have been told of Facebook posts telling members of the public how to create them. Whilst sometimes the false results can be identified upon a close inspection, at times the forgery is indistinguishable from the real version.

Members should consider where appropriate:

including in orders sought:
requiring the party undertaking the test to cause the test provider to send the results directly to the other parties or the Independent Children's Lawyer;
authorities for other parties or the Independent Children's Lawyer to contact the test provider directly to obtain copies of results;
issuing a subpoena to the test provider to obtain the original version of the results.
As well as identifying false results, those steps may identify results that have not been disclosed.

The Expanded AML/CTF Regime - What Family Lawyers Need to Know 🎙️

Lawyers have received a range of information about the expanded regime under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) from different sources. It can be difficult to know when an engagement for a family law matter 'tips over' into being a designated service.
In today's episode, FLPA Immediate Past President Shannon Daykin is joined by Jess Smith, Director at Grant Thornton. Jess has over 15 years' experience providing advice and guidance on anti-money laundering and counter-terrorism financing. Most recently, Jess has guided practitioners as they prepare for Australia's expanded AML/CTF regime, and worked with AUSTRAC to support the development of the AML/CTF Starter Kits for Lawyers.

Join us as Jess explains the legislation, what activities undertaken by family lawyers for clients may or may not be deemed a designated service under the legislation, and more. This is a must listen for all family lawyers.
